Google and Spain battle over privacy rights

Google and Spain have argued their cases at the Court of Justice of the European Union. Google argued that it will not delete information unless it meets certain criteria and Spain believes that Google has breached the "right to be forgotten."

On Feb. 26, the Court of Justice of the European Union (CJEU) heard arguments in Google's latest case. Spain's Data Protection Agency has ruled that Google breached individuals? right to be forgotten. As a result, the search engine giant was ordered to take down links or information that can be deemed as harmful to an individual. Google, stating that such an action would set a precedent, has taken the trial to the CJEU.

?There are clear societal reasons why this kind of information should be publicly available. People shouldn't be prevented from learning that a politician was convicted of taking a bribe, or that a doctor was convicted of malpractice,? writes William Echikson, Google?s head of Free Expression for Europe, the Middle East, and Africa, on an official Google blog. ?The substantive question before the Court today is whether search engines should be obliged to remove links to valid legal material that still exists online.?

It all began when a Spanish man performed a vanity search, Googling his own name to see what popped up. To the man?s surprise, he found a link to an article from several years ago. The article detailed that a property he owned was up for auction since he had not paid his social security contributions. Now, this is just one of roughly 180 cases that Google has going on in Spain.

Mr. Echikson also writes in the company blog that Google already removes information that is found to be ?incorrect, defamatory or otherwise illegal.?? It?s important to note that an algorithm decides Google?s search results. Since the search engine giant does not monitor the algorithm beyond looking for information that is ?incorrect, defamatory or otherwise illegal,? Google has no editorial position. As a result, Google cannot be hit with a libel lawsuit. This was the case argued in 2012 when Germany?s former first lady, Bettina Wulff, sued the Internet search giant.

The DailyTech writes that this will be the CJEU?s opportunity to find out if Google should be held responsible for its actions, as a ?controller? of information, or whether it was merely acting as a host of information.

Another question that the CJEU will have to solve is whether or not Google is in its jurisdiction. Google, based in the US, might not be subject to European privacy laws.?

If Google is found to be outside of the EU?s jurisdiction, than the many cases it faces could go away.

The CJEU is expected to reach a conclusion by the end of the year.

Calif. female lawmakers condemn Oscar host

SACRAMENTO, Calif. (AP) ? Two female California state lawmakers have condemned Oscar host Seth MacFarlane's comments during Sunday's awards presentation as degrading toward women and asked the Academy of Motion Picture Arts and Sciences to use better judgment in the future.

Assemblywoman Bonnie Lowenthal and Sen. Hannah-Beth Jackson, both Democrats who lead the Legislature's women's caucus, sent a letter to Academy President Hawk Koch on Tuesday, requesting that the organization disavow MacFarlane's behavior.

They objected to the comedian's focus on the physical appearance of several actresses and quips about nude scenes.

"Furthermore, there was a disturbing theme about violence against women being acceptable and funny," the lawmakers wrote. "From topical jabs about domestic violence to singing about 'boobs' during a film's rape scene, Seth MacFarlane crossed the line from humor to misogyny."

MacFarlane's performance has drawn multiple critics since Sunday's show. Blogs compiled highlights of his punch lines, which included a song that referenced leading ladies who have bared their breasts on film that were accompanied by reaction shots from those actresses.

He also made light of a domestic violence incident between rapper Chris Brown and singer Rihanna, and joked about the heavy accents of several Latina actresses.

"On Oscar night, when Hollywood seeks to honor its best, Seth MacFarlane's monologue reduced our finest female actresses to caricatures and stereotypes, degrading women as a whole and the filmmaking industry itself," the letter stated.

Lowenthal and Jackson, both Democrats, asked Koch to respond. Academy spokeswoman Toni Thompson had no immediate comment.

In their letter, the lawmakers noted the Violence Against Women Act currently under debate in Congress and a resolution that the Legislature passed supporting the act's reauthorization. Better judgment is needed in the academy's future decisions regarding its awards show hosts and their material, they said.

"This should be a celebration of artists in the filmmaking industry, not an offensive display of disrespect toward women that sets the fight for gender equality, dignity, and respect back decades," they wrote.

A repeat hosting performance by MacFarlane doesn't look likely. Asked Tuesday on Twitter if he would host the Oscars again, he replied, "No way. Lotta fun to have done it, though."

Researchers find controlling element of Huntington's disease

Huntington's disease, also known as Huntington's chorea, is a hereditary brain disease causing movement disorders and dementia. In Germany, there are about 8,000 patients affected by Huntington's disease, with several hundred new cases arising every year. The disease usually manifests between the ages of 35 and 50. To date, it is incurable and inevitably leads to death. It is caused by a specific genetic defect: In the patient's DNA, which is the carrier of genetic information, there are multiple copies of a certain motif. "Repeats like this are also found in healthy people. However, in cases of Huntington's disease, these sequences are longer than usual," explains Dr. Sybille Krauss from the DZNE in Bonn.

The long DNA sequences in Huntington's disease lead to changes in a certain protein called "Huntingtin". The DNA is like an archive of blueprints for proteins. Errors in the DNA therefore result in defective proteins. "Huntingtin is essential for the organism's survival. It is a multi-talent which is important for many processes," emphasises Krauss. "If the protein is defective, brain cells may die."

In the spotlight: protein synthesis

In the current study, the scientists around Sybille Krauss and the Mainz-based human geneticist Susann Schweiger took a closer look at a critical stage of protein production ? translation. At this step, a copy of the DNA, the so-called messenger RNA, is processed by the cell's protein factories. In patients with Huntington's disease, the messenger RNA contains an unusually high number of consecutive CAG sequences ? CAG representing the building plan for the amino acid glutamine.

These repetitive sequences have a direct consequence: more glutamine than normal is built into Huntingtin, which is therefore defective. Sybille Krauss and her colleagues have now identified a group of three molecules, which regulate the production of this protein. "We were able to show that this complex binds to the messenger RNA and controls the synthesis of defective Huntingtin," says Krauss. When the scientists reduced the concentration of this so-called MID1 complex in the cell, production of the defective protein declined.

"If we could find a way of influencing this complex, for example with pharmaceuticals, it is quite possible that we could directly affect the production of defective Huntingtin. This kind of treatment would not just treat the symptoms but also the causes of Huntington's disease," says Krauss.

Background:

Three molecules come together

The complex consists of MID1, from which it gets its name, and the proteins PP2Ac and S6K. "Every single one of these proteins is known to be important for translation. We have discovered that in the specific case of Huntington's disease, they together bind to the CAG sequences. This was previously unknown. We also found that binding increases with repeat lengths," says Krauss. "In sequences of normal length, we found only weak binding or none at all."

The Bonn-based molecular biologist and her colleagues investigated the effect of the MID1 complex and the interaction between its components in a series of elaborate laboratory experiments. "This project took several years of research work," says Krauss. Along with biochemical procedures, the scientists used cell cultures and analysed proteins from the brains of mice. The mice's genetic code had been modified in such a way that it contained elongated CAG-repeats as it is typical for Huntington's disease.

From previous studies it was already known that the protein MID1 tends to bind messenger RNAs. The scientists were now able to show that MID1 also attaches to messenger RNAs with excessively long CAG sequences. Furthermore, experiments showed that PP2Ac and S6K also bound the RNA in the presence of MID1. However, if the MID1 was depleted, this binding did not occur. "From this, we can conclude that these three proteins form a molecular complex, which binds to the RNA. MID1 is a key component. It actually seems to keep together its binding partners," Krauss comments on the results of the experiments.

Complex controls protein production

The researchers were also able to prove that the MID1 complex controls the translation of RNA with excessively long CAG sequences. For this, they investigated various cell cultures. The cells produced either normal Huntingtin or ? due to excessively long sequences in their DNA ? a defective version of this protein. The scientists reduced the occurrence of MID1 inside the cells using a procedure known as "knock-down". The elimination of this protein, which is a major part of the MID1 complex, had direct consequences: the production of defective Huntingtin declined. "However, it did not affect the production of normal Huntingtin," emphazises Krauss. "This further proves that the MID1 complex specifically targets RNAs with excessively long CAG sequences."

Highly specific

The Bonn-based molecular biologist sees this specific influence as a chance to treat Huntington's disease: "The MID1 complex is a promising target for therapy. It indicates a possibility to suppress the production of defective Huntingtin only, while not affecting the production of normal Huntingtin. This is of particular significance, because the normal protein is also being produced in the patients' bodies and it is important for the organism."

A suitable active substance has yet to be found, says Krauss. However, the next developments are in sight: "We now want to test potential substances in the laboratory," she says.

CLEVELAND (AP) ? The story of The Rolling Stones is so huge it takes 2? floors of The Rock and Roll Hall of Fame and Museum to tell.

The Cleveland-based museum will open "Rolling Stones: 50 Years of Satisfaction," an exclusive exhibit celebrating the archetypal rock band, on May 24.

The exhibit will be open until March 2014 and will include personal and collected items that have never before been seen by the public along with film, text and interactive components and periodic lectures on the band's 50-year career. The entire exhibit will take up more than two floors of the museum.

Mick Jagger, Keith Richards and The Stones recently held a series of concerts to celebrate their 50th year together and there have been rumors of more activity.

Steven and Alexandra Cohen Veterans Center to conduct biomarker research for accurate diagnosis of 'invisible injuries of war'

New York City, February 25, 2013Funded by what is believed to be the largest private donation to post-traumatic stress research, NYU Langone Medical Center is establishing a new veterans' mental health research center to study post-traumatic stress and traumatic brain injury (TBI) and conduct biomarker research necessary to accurately diagnose these conditions.

The center, made possible by a $17 million lead gift from the Steven and Alexandra Cohen Foundation, will be led by Charles Marmar, MD, the Lucius N. Littauer Professor of Psychiatry and chair of NYU Langone's department of Psychiatry, who is known for his long-standing work in these fields. Dr. Marmar also heads NYU Langone's Military Family Clinic, established in July 2012 to fill the gap in mental health care for Afghanistan and Iraq war veterans and their families in the New York City region.

The center will be named the Steven and Alexandra Cohen Veterans Center for the Study of Post-Traumatic Stress and Traumatic Brain Injury ("Cohen Veterans Center") in recognition of the grant from the Cohens.

"The Cohens' investment will turbo-charge research conducted on these conditions," said Dr. Marmar, "and reflects the Cohens' dedication to helping preserve the mental and physical health of veterans.

"Without objective biological tests, the diagnosis of post-traumatic stress disorder (PTSD) and TBI is incredibly difficult to get right," said Dr. Marmar, noting the long-term effects of these conditions include depression, substance abuse, family turmoil and suicide. "We thank Steven and Alexandra Cohen for their generous gift which will allow us to accelerate the discovery of biomarkers to identify PTS and TBI, create lab tests for these disorders, and ultimately use this knowledge to develop novel treatments including targeted medications and other therapies."

NYU Langone Medical Center is one of a limited number of places in the country to simultaneously focus on both conditions under one roof. The Cohen Veterans Center will work with leading psychiatrists and neuroscientists at institutions around the country on biomarker identification in addition to the ongoing research NYU Langone conducts as a result of its long standing relationships with two large urban VA hospitals in Manhattan and Brooklyn. Immediate Past Chairman of the Joint Chiefs of Staff and retired Navy Admiral Michael Mullen will serve as Chairman of the Advisory Board for the new Center.

"We cannot understate the importance of this project," said Steven Cohen. "Every veteran deserves access to treatment for the trauma he or she experienced while defending our country. Our hope is that new, objective diagnostic tests and treatments for post-traumatic stress and traumatic brain injury will emerge from the Cohen Veterans Center that will have far-ranging effects on the care of these heroic veterans and provide them with the opportunity to lead a normal life."

'Thx,' 'tweetable,' 'dumbphone' now in Oxford Dictionary

More hi-tech words have found their way into Oxford Dictionary's online English version, and some of them couldn't be shorter.

Thx to the lexicographers at Oxford Dictionaries who added a fresh round of tech jargon to its online English dictionary, you can now look up words like "thx."

Some of today's (Feb. 22) additions will be familiar, such as "tweetable" and "social sharing," which refers to people's growing need to post every piece of daily trivia to the Internet. (Thanks for that Instagram of your sushi dinner last night.) You can probably guess at others, like "dumbphone," even if you don't use the term yourself.

But "touchless," for example, might not be as intuitive. According to Oxford, the term refers to gesture-control devices such as Microsoft's?Kinect??gaming accessory that uses a camera to interpret body motions for game-play.

Still other entries might indeed have people turning to Oxford online to check definitions. "Cruft"? A new addition that means badly designed or unwanted software. And what about "range anxiety"? This term will surely be heard more frequently as electric cars become more common and drivers worry whether they'll make it to their destination before the?car's battery dies.

Each new word and phrase added to Oxford goes through a fairly rigorous assessment, whether it began as a suggestion from the public or if the Oxford team itself suggested the word. If a proposed entry is used by just one segment of the population, like young teens, it's disqualified. If it's a trademark, it must have broader use, such as generic use as a verb. (Have you?googled??anyone lately?)

Oxford consults specialists when necessary, and the dictionaries' editors review proposed entries. Those that make the cut are added to the online dictionary, and later, to printed versions.

The quarterly updates may please Scrabble players hunting new words, but remember, just because a word has been blessed by Oxford Dictionaries, doesn't mean it's okay for Scrabble. For instance, Oxford added LOL back in 2011, but Scrabble Checker still says "no."

Enrollment decrease in student health insurance provided through ...

Jamelia Little, a fourth year child and adolescent development major, said she was never informed of the supplementary health insurance offered to students through the Associated Students.

The campus should be more direct when it comes to informing students about health insurance options, she said.

?Sadly, I do not have insurance,??Little said.

Little said her health insurance was cut when she was 18?because her parents became unemployed, which forced her to go to the Student Health Center.

"I was kind of forced to attend the health center because I had no where else to go," ?she said.

SJSU students pay a mandatory health fee in their tuition that provides students with basic services for free but students who need outside hospitalization or treatment not available at the health center may need to purchase supplemental health insurance, according to Shawn Chan, finance and accounting manager.

Chan, who has been working at SJSU for almost 19 years, said when he first got the job student health insurance was already being provided to students.

The Student Health Insurance program is a contract with the CSU system and ?all other campuses have the same coverage," Chan said.

According to the Student Health Insurance booklet, some of the services covered are diagnostic X-ray and lab tests, emergency care, pregnancy and maternity care, preventative care and speech therapy.

During the?2009-10 fiscal year, a total of 705 students were enrolled in the Student Health Insurance Program, but the following two fiscal years?experienced an enrollment decrease?to a number of 340 students during 2011-12, according to Chan.

Chan said the drop in the students enrolled in the program was because of President Obama?s health reform.

?Due to Obama?s health reform the dependent age extended to 26 years old, and that resulted in the anticipated drop in student enrollment,? he said.

Under the student health insurance program students can go to the health center for minor treatment but for severe?treatment the health center will refer them to a hospital,?Chan said.

?The initial part is they have to go to the health center first for reference outside for special treatment in case the Health Center cannot do anything about it,? he said.

Jessica Silva, a senior liberal studies major, said she was not aware the school provided health insurance but she thinks it?s a good thing for students who aren?t covered.

?Its an excellent idea for the school to provide health insurance,? she said, ?especially for students who pay their way through school, don?t get benefits from a job they work or don?t have parents who provide health insurance for them.?

The four years Silva lived on campus she said she used the health center a total of three or four times.

The Student Health Program offers plans to students of all ages, their spouses and children, Chan said.

According to Chan, because the dependent?s age has been extended to 26, the most popular plan?is?for students ages 25?to 30.

?Different people can buy it (insurance) for one semester,? he said.

According to the Student Health Program booklet, for students age 25?to 30 who are interested in enrolling for the annual program, the price would be $3,874 but can go as high as $12,442 for students ages 50 and over.

For a spring?and summer?semester the cost would range from $1,668 to $7,239 for students, according to the booklet

Students who decide?they?d like to?enroll?or renew health insurance?can go to general services in the Student Union and grab a booklet, which has an enrollment form in the back, Chan said

According to Chan, students can also enroll online and pay by credit card. No payments go through the university, he said.

In South Carolina, disgraced former governor seeks a resurrection

CHARLESTON, South Carolina (Reuters) - The scheduled appearance by a candidate for South Carolina's 1st Congressional District here last week was behind schedule. The event's co-host, an undertaker, had been detained at his funeral home by an unexpected "delivery."

A couple of people in the audience laughed as they realized what sort of delivery a funeral home receives. Questions of life and death seemed oddly appropriate because the afternoon's guest of honor was a man who is trying to undergo a political resurrection: former South Carolina Governor Mark Sanford.

As governor in early 2009, Sanford - a tanned conservative Republican who preached limited government - was widely seen as a potential candidate for president in 2012.

But then he disappeared for six days in June 2009, without telling his family or staff. It turned out he was in Argentina, visiting a woman with whom he was having an extramarital affair. The episode destroyed Sanford's marriage and earned him a censure from state legislators who agreed that he had brought "dishonor, disgrace and shame" to South Carolina.

And that, it seemed, was the end of the Mark Sanford story.

He served out his term as governor but left office in January 2011 and headed for his family's farm in Beaufort, South Carolina. He became a footnote in a state whose recent political history has been shaped by the rise of the conservative Tea Party movement and the legacy of the late Strom Thurmond, a one-time segregationist and governor who served in the U.S. Senate for nearly a half-century.

Now Sanford, 52, is back - in search of a dramatic comeback by running for the same congressional seat that he won almost two decades ago, before he was governor.

In talking about putting his life back together, Sanford gives off new-age vibrations. During an interview with Reuters, he seemed well-versed in the language of recovery and often referred to his "inner journey."

Even without Sanford and reminders of his scandal, the race has the makings of spectacle: It features 16 candidates in the Republican primary on March 19, including Robert "Teddy" Turner, the rebel conservative son of Ted Turner, the liberal cable television billionaire.

For Sanford, it was a surprising opportunity created by the unexpected retirement of U.S. Senator Jim DeMint, which caused a shift in the state's Republican leadership. Governor Nikki Haley appointed Representative Tim Scott to fill DeMint's seat. The opening of Scott's seat gave Sanford a chance to return to public life that Sanford said he found irresistible.

Given that voters are familiar with Sanford - some of whom have cast ballots for him five times - most analysts expect Sanford to outlast the Republican field, even in a district where some religious conservatives could find it hard to forgive him.

Many of the 15 other Republicans concede that they are hoping to finish second to Sanford, then have other candidates' supporters rally around them (and against the former governor) in a primary run-off vote.

There is another twist: The Republican primary winner is likely to face on May 7 in a special election Democrat Elizabeth Colbert-Busch, an official at Clemson University and sister of comedian Stephen Colbert, who has been known to bring his antics into South Carolina politics. Colbert was scheduled to join his sister at a fundraiser on Sunday night.

The conservative district has sent a Republican to Congress since Ronald Reagan was elected president in 1980. So most political analysts in South Carolina expect Sanford to eventually win back his old congressional seat despite his scandal and a celebrity presence on the Democratic side.

But first, Sanford is making the case that he has learned from his fall and moved past his mistakes.

During a coffee gathering on Thursday, Sanford pointed to a woman in the audience he had talked with earlier.

"She said, ?Mark, quit apologizing,' " Sanford recalled. "I know I need to do that. She said, ?You did that on the first day. People got that. You need to move on.' And I said, ?Indeed, I do.' "

HIS ?INNER JOURNEY'

During the interview, Sanford said the past few years have changed him for the better.

After confessing to cheating on his wife, he was stripped of his position atop the Republican Governors Association. Six months later, his wife divorced him. He is now engaged to Maria Belen Chapur, the Argentine journalist whom Sanford called his "soulmate" during a news conference after the scandal broke, and for whom Sanford gave up his old life.

Meanwhile, Sanford's ex-wife, Jenny Sanford, who used to manage his campaigns, published a memoir titled "Staying True."

After leaving the governor's office and returning to his farm, Sanford said he spent time building a bridge, a cabin and barn with his four sons. He showed off a bruised fingernail, which he said was caused by a falling plank of wood.

"In the wake of so much destruction, I wanted to construct," he said in the interview.

Sanford's longtime friend Tom Davis, his former chief of staff, said that Sanford's time in near-isolation was "Thoreauvian," comparing the former governor's days on the farm to the writer Henry David Thoreau's psychologically therapeutic years living near Walden Pond in Massachusetts in the 1850s.

Sanford seems to agree.

"I said to a buddy, 'You know, I'm becoming a Buddhist Christian,' which is sort of a weird way of putting it, but you know Buddhism focuses on the moment," Sanford said. "I think that ... Western society achievers, whatever your walk of life, are always focused on the next step."

For the most part, Sanford leaves his personal life out of the campaign. He thinks that voters are willing to do the same - even as some opponents' ads have questioned his honesty.

"I've experienced how none of us go through life without mistakes," Sanford said in his first campaign ad released this week. "But in their wake, we can learn a lot about grace, a God of second chances, and be the better for it."

One voter who heard Sanford speak on Thursday in Charleston said that times had changed, particularly among South Carolina Republicans who voted for former U.S. House speaker Newt Gingrich in last year's Republican presidential primary.

Many people in the state backed Gingrich despite fresh allegations that Gingrich had once asked a former wife for an open marriage. Gingrich supporters said they were less concerned with Gingrich's personal life than his politics, and that they favored him as a more conservative alternative to Mitt Romney, the Republicans' eventual nominee for president.

But, "if it had been 25 years ago ... good Lord," said Anne Keigher, 75, an architect from Charleston.

At a time when Washington is viewed by voters as a politically gridlocked failure, Sanford talks about his three terms as a congressman as a success.

He also says he was railing about government spending before it was stylish. His sunny disposition can turn apocalyptic when he talks about debt and the value of the U.S. dollar.

'I BLEED'

The unfolding drama in Washington over taxes, debt and spending seemed a bit distant, however, when Sanford and 12 other Republican candidates appeared Thursday at a Golden Corral restaurant in Blufton. Each was given five minutes to make a case to members of the Beaufort County Republican Club.

Sanford did not mention his family nor the scandal that put him in national headlines. He did brag about shortening the wait times at the state Department of Motor Vehicles as governor.

Some of Sanford's rivals are frustrated by the attention he gets. One candidate refused to answer questions about Sanford. Another dismissed the "air of celebrity" surrounding the race.

One challenger, Andy Patrick, a former U.S. Secret Service agent who praised his rivals for their conservative values, has sent out a mailer to voters attacking Sanford.

"Many will forgive," it reads, "But how can we forget? Mark Sanford. The trust is gone."

After the turmoil of the last four years, is Sanford comfortable with the attacks that are coming his way?

"No," Sanford said in the interview. "I'm a human being. I bleed."

BARCELONA, Spain ? Samsung Electronics is beefing up its tablet range with a competitor to Apple?s iPad Mini that sports a pen for writing on the screen.

The Korean company announced on Sunday in Barcelona that the Galaxy Note 8.0 will have an 8-inch screen, putting it very close in size to the Apple?s tablet, which launched in November with a 7.9-inch screen. It?s not the first time Samsung has made a tablet that?s in the Mini?s size range: it?s very first iPad competitor had a 7-inch screen, and it still makes a tablet of that size, but without a pen.

Samsung will start selling the new tablet in the April to June period, at an as yet undetermined price. It made the announcement ahead of Mobile World Congress, the wireless industry?s annual trade show, which starts Monday in Barcelona, Spain.

The Note 8.0 fills a gap in Samsung?s line-up of pen-equipped devices between the Galaxy Note II smartphone, with its 5.5-inch screen, and the Galaxy Note 10.1, a full-size tablet. Samsung has made the pen, or more properly the stylus, one of the tools it uses to chip away at Apple?s dominance in both tablets and high-end smartphones. Apple doesn?t make any devices that work with styluses, preferring to optimize its interfaces for fingers, mice and touchpads.

On Samsung?s Note line, the pens can be used to write, highlight and draw. The screens also sense when the mouse hovers over the screen, providing an equivalent to the hovering mouse cursor on the PC. However, few third-party applications have been modified to take full advantage of the pens.

Facebook's plan for West Campus to be reviewed Monday by Menlo Park planners

Facebook's plan to build a second campus on the west side of Bayfront Expressway moves to the Menlo Park Planning Commission on Monday.

The social network company has asked the city to rezone its 22-acre West Campus site because the building height there is now limited to 35 feet.

The 43,555-square-foot office and rooftop park that Facebook wants to build above a surface-level parking lot would reach a height of 73 feet, according to city documents. The building has been designed by celebrated architect Frank Gehry.

The commission also will consider approving an official statement that the development's benefits would outweigh its negative environmental impacts. According to a city memo, one significant and unavoidable impact could be additional traffic at the intersections of Marsh and Middlefield roads and University Avenue and Donohoe Street. Construction noise is another potential impact.

In addition, the commission is to consider allowing removal of 175 heritage trees and approving Facebook's agreement to provide either $4.5 million in fees to the city for affordable housing or put up 15 affordable housing units elsewhere, or a combination of both.

In January, the city council approved a development agreement for the West Campus project that calls for Facebook to pay Menlo Park $1.5 million over 10 years and $100,000 for local improvements, and to restrict the number of vehicles entering and leaving the new campus. Facebook

also has committed to pay the city at least $194,000 a year in property taxes.

The West Campus, previously occupied by Tyco Electronics at 312 and 313 Constitution Drive, would be given the new address of 1 Facebook Way. About 2,900 employees will work there, according to project documents.

The new building will be linked to the main campus -- the former headquarters of Sun Microsystems -- via a tunnel underneath Bayfront Expressway. The main campus has been permitted to accommodate as many as 6,600 employees.

The planning commission will meet in the council chambers, 701 Laurel St., at 7 p.m.

NOAA warns man for harassing whale off Florida beach

A man has been given a warning letter for harassing a sperm whale that died while languishing off Florida's Pompano Beach two months ago, the National Oceanic and Atmospheric Administration said Thursday.

In the written warning issued earlier this month, NOAA's Office of Law Enforcement told Anthony Armento that he violated the Marine Mammal Protection Act, which prohibits people from harassing, capturing, hunting or killing whales and other marine mammals.

The alleged harassment occurred the morning of Dec. 16 in the waters off Pompano Beach, when a man was seen getting on top of a sperm whale by a witness, who photographed the bizarre encounter from afar.

The whale, pronounced dead hours later that day, was thought by marine scientists to have been ailing at sea long before the whale was harassed. Still, responding to reports of the man harassing the whale, NOAA's Office of Law Enforcement investigated and said it identified Armento as the violator.

Armento couldn't be reached for comment Thursday, despite a visit to a listed address. The letter stated that he was eligible to appeal the finding within 30 days of receiving the letter, NOAA said.

The Marine Mammal Protection Act (MMPA), enacted in October 1972, was established to protect and conserve marine mammals, according to Erin Fougeres, a marine mammal scientist with NOAA.

"The MMPA is the primary mechanism that we have to manage and conserve marine animals in the United States," Fougeres said. "It does make it illegal to harass, hunt, capture, kill or attempt to do any of those things to a marine mammal."

Violations can result in a civil penalty up to $11,000, as well as criminal penalties up to $100,000 and imprisonment of up to a year or both. Violators include those who approach the marine mammals too closely to watch, feed or swim with them.

"We recognize that these are important animals in the marine environment, and also animals that the public enjoys seeing in the wild," Fougeres said. "And the act is really primarily to protect them so that we have them around for future generations."

Despite people's fascination with marine mammals, they should not near them for everyone?s safety, Fougeres said.

"You want to make sure that as you're observing them, you're observing them from a safe distance and in a manner that would not change their natural behavior," Fougeres said.

In Armento's case, the purpose of NOAA's issuing him a written warning was to document the violation, NOAA said. It also could be used to justify a more severe penalty if any future violations involving him occur, NOAA said.

"When proceeding with investigations and prosecutions, NOAA considers such things as the violator's intention or state of mind, the effect of a violation on the resource, the need for specific and general deterrence, etc.," NOAA said in a statement. "In this case, after considering the facts of the case, NOAA determined that a written warning was an appropriate outcome."

Photos provided to NBCMiami.com by a witness showed two swimmers nearing the whale the day of the incident, though only one person was seen in a picture on top of the whale. NOAA on Thursday did not say whether the second swimmer was cited.

The day of the incident, witness Margie Casey told NBCMiami.com that she saw two swimmers twice go up to the whale. She said she watched them from her fifth-floor balcony and snapped photos of the one swimmer getting on the whale.

Casey said the whale had been drifting north along the shore, just south of a stretch of beach near the Northeast 14th Street Causeway. Casey said she considered the whale to be alive at the time, because it was flapping its tail. Perhaps the whale was on its "last leg," Casey said in a Dec. 16 interview. "So sad."

A specialist went into the water later that day and determined the sperm whale had died, officials said. The next day, the dead whale washed up around Deerfield Beach's fishing pier. It then was towed more than five miles out to sea to dispose of its carcass, officials said.

The Pompano Beach whale case is among the latest in a series of cases in Florida involving the harassment of animals.

Sunday, a?Fort Pierce, Fla., man was arrested?on the charge he violated Florida law by illegally playing with and handling a manatee calf, then posting Facebook pictures of the encounter, authorities said. And in November last year, a?St. Petersburg, Fla., woman was arrested?on a misdemeanor charge of violating state law by riding a manatee, officials said.

NOAA encourages anyone who sees possible violations of the Marine Mammal Protection Act to report it to NOAA's enforcement hotline at 1-800-853-1964. Anyone who sees a stranded, injured or entangled marine mammal may report it to the Southeast Regional Marine Mammal hotline at 1-877-942-5343.

Wind turbine boosts Ind. St. energy sustainability

TERRE HAUTE, Indiana ? A chilly breeze rumpled the ribbon a bit as a new wind turbine was dedicated on Indiana State University grounds.

ISU welcomed "Helix" home Friday afternoon, amid windy weather many joked was quite appropriate. Painted Sycamore blue, the turbine stands about 30 feet off the ground and is powered by curved, vertical blades. Rotating by wind power, the blades are expected to help generate between 5,000 and 11,000 kilowatts annually to offset the university's energy usage.

ISU President Dan Bradley commented on the sustained effort of all involved.

"It's great to finally have this day," he told The Tribune Star (http://bit.ly/Xsu7zk).

Situated between Rhoads and Mills Residence Halls, the turbine was officially named "Helix" through a campus contest which drew more than 200 submissions. Sophomore Brett Ferry offered the successful name, it was announced at the contest.

Bradley said the idea for a campus wind turbine grew out of the university's strategic plan as part of the Unbounded Possibilities Initiative and its offshoot, the Institute for Community Sustainability. The turbine coincides with the university's Climate Action Plan, which seeks to make the campus carbon-neutral by 2050.

Terre Haute Mayor Duke Bennett said ISU remains a community leader in the effort toward sustainability. Meanwhile, the aesthetic quality of the turbine is also a plus.

"It looks great. It looks like a piece of art," he said.

More than 450 environmental sciences students actively participated in the project, analyzing wind data to determine the best location for a turbine.

Sabrina Brown, a student involved in the project, reported that she's presented her climatological research at a national conference and has been asked to publish a paper about her findings.

Brown said students caught the wind in anemometers to measure speed at 50 points across campus. Student data collected as early as the 1960s was also utilized in the research, she said.

"To me, the coolest part of the project was that students were able to participate from beginning to end," she said.

Bill Would Legalize Roadkill Dining

By passing a bill last week that allows motorists to eat their roadkill, the Montana House of Representatives may be on their way to legalizing the ultimate drive-through experience.

State Rep. Steve Lavin originally introduced the bill into Montana's House to allow "game animals, fur-bearing animals, migratory game birds and upland game birds" who have been killed by a car to be harvested for food.

"This includes deer, elk, moose and antelope, the animals with the most meat," said Lavin.

Lavin said that in his "day job" as a state trooper he sees a ton of animals hit on Montana's roadways that could potentially be repurposed to provide meat for people in need. State troopers already alert food banks to viable bumper banquets. This bill would simply make the practice legal.

If passed, Lavin said the law would explicitly exclude species such as big horn sheep and bear over concerns there would be profiteering from horns, claws and other body parts collectors covet. He added that it certainly wouldn't apply to situations like "finding a dead squirrel in the middle of the road" either.

Collisions between vehicles and animals are a serious problem in rural states like Montana. In 2011, the last year statistics were available, the Montana Department of Transportation reported a little over 1,900 wild animal?vehicle crashes. Considering nearly 7,000 carcasses were collected from the side of road that same year, it seems likely that many such accidents go unreported.

It's worth noting that Montana is not the first state to pass this type of law. Colorado, Illinois and Indiana are among states that currently allow motorists the privilege of salvaging roadkill under certain circumstances.

It's legal in Georgia too, a fact depicted on the reality show, "Here Comes Honey Boo Boo." In an early episode "Mama June" Shannon explained how police notify her whenever a deer who has met an unfortunate end is found by the side of the road. She then goes on to extol the virtues of dining on deer that die by the wheel ? though she has stressed in interviews that the family does not consume possum or raccoon.

"Darleen", as Honey Boo Boo lovingly referred to the family's fender feast, may be delicious ? but how safe is it to partake?

"The risk is relative depending on the condition of the animal and how it was killed," said Benjamin Chapman, a food safety specialist with North Carolina State University. "In roadkill if you happen upon the animal, you don't know its condition, which makes it riskier than eating regulated food or an animal you've hunted."

Even before you put fork to antler, there are safety concerns. Just hauling a carcass away can expose you to all sorts of pathogens that can make you sick, Chapman warned.

Lavin said he had never eaten roadkill himself but had no misgivings about offering the run-over meat to those who can use it -- though for safety's sake, he advised anyone pondering these "meals under wheels" to take air temperature and the length of time the animal has been lying on the road into consideration.

"It's like any other meat ? if you leave it outside the refrigerator for a couple of hours, you aren't going to want to eat it," he said.

Should you decide that flattened moose is what's for dinner, Chapman advised using a meat thermometer and cooking large game to a temperature of at least 160 degrees Fahrenheit. When dressing the carcass, keep it away from other foods, scrub work surfaces with bleach afterward, and wash hands thoroughly.
